A bill, SB2506, to ban aspartame,
was introduced by state Senator J. Kalani English
of Hawaii's 6th district, including east and upcountry Maui.
He is chairman of the Transportation and International Affairs
Committee.
For the upcoming 2008 session, Senator English has also been appointed
Vice Chair of the newly created Senate Committee on Agriculture and
Hawaiian
affairs.
Senate sessions are in the capitol, Honolulu.
There are thousands of bills and resolutions submitted each year to
the
Legislature.
Senator English introduced or cosigned 160 bills and resolutions in
the 2007
session.
Seventeen of those bills passed into law, four of which Senator
English
introduced himself.
The status of SB 2506 in the Hawaii State Senate
is that it has been referred to the Senate's Health Committee. ]

Hawaiian aspartame bills challenge corporate clout

The Hawaii legislative session is considering Senate Bill 2506 and
House
Bill 2680 to ban the artificial sweetener and neurotoxin aspartame.
This is wonderful news coming from Hawaii. The legislators and their
bill
drafters saw the merit in keeping almost all of the same language from
the
2006 and 2007 New Mexico bills, especially regarding the state's
rights and
its obligation to protect the citizens' health, which are not "pre-
empted by
massive failures at the FDA."
These bills were overwhelmed and eviscerated in New Mexico by some of
the
most vicious corporate lobbyists I have ever encountered,
representing
Ajinomoto of Japan, the world's largest manufacturer of both aspartame
and
MSG, as well as their duped American corporate henchmen and
partners-in-poisoning who use massive amounts of aspartame, such as
Coca-Cola, Pepsi, Altria, Kraft and others.
Make no mistake: the same corporations and even more will show up in
Honolulu. Probably including Wrigley's Gum, all of whose products
contain
aspartame, which is metabolized as methanol and formaldehyde.
These corporations have everything to lose if such bills advance and
lead to
the inevitable product-liability and personal-injury suits from those
damaged by aspartame, who number in the hundreds of millions, despite
their
corporate-serving propaganda and lies.
My most profound appreciation goes to the numerous fine Hawaii
activists who
brought up these imperative issues, and to
Sen. J. Kalani English, chairman of the International Committee,
and Rep. Calvin Say, Speaker of the House, both Democrats,
who see the merit and need to protect the health of all Hawaiians --
no matter what duplicity is perpetuated by the top brass and
corporate
lackeys at the FDA.
The Senate bill is cosponsored by Suzanne Chun Oakland,
chairperson of the Senate Health and Human Services Committee,
and we sincerely commend these fine legislators for this pre-emptive
and
protective legislation.
I hope Hawaii legislators don't capitulate to the corporate-serving
theories, advanced by corporate lobbyists, that states do not have
the
right, power or obligation to challenge any kind of federal authority,
such
as an FDA pronouncement.
When aspartame's history of approval is examined, it will be clear
that the
FDA commissioner, in 1981, was under a strong influence to approve
this
chemical, no matter who objected in the medical and scientific
community,
because the guy from former President Ronald Reagan's "Transition
Team" who
gave him the job, Donald Rumsfeld, had been CEO of the aspartame
manufacturer G.D. Searle. Rummy made $25 million off this deal alone.

We describe a case of epileptic seizures after a massive intake of
diet coke.
Apart from the hyponatremia due to water intoxication the
convulsions can be potentiated by the high dose of caffeine and
aspartame from the diet coke.
To our knowledge this is the first report of seizures due to

THE SENATE S.B. NO. 2506
TWENTY-FOURTH LEGISLATURE, 2008
STATE OF HAWAII
A BILL FOR AN ACT relating to food.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds it is imperative for the public
health,
safety and welfare to declare that aspartame and its derivative
compounds,
in all of their trade names, are poisonous and deleterious food
additives
due to their neurotoxic and carcinogenic metabolites.
The legislature finds that federal authorities have not intended to
or
expressed an intention to occupy and preempt areas of concern
regarding the
prohibition of toxic, neurotoxic, carcinogenic, poisonous or
deleterious
food additives, and therefore the legislature may prohibit the sale
of
products containing aspartame and its derivative compounds in order
to
protect and ensure the public health, safety and welfare.
SECTION 2. Section 328-1, Hawaii Revised Statutes, is amended by
adding a
new definition to be appropriately inserted and to read as follows:
""Aspartame" means the artificial sweetener with the technical name
L-aspartyl-L-phenylalanine methyl ester."
SECTION 3. Section 328-6, Hawaii Revised Statutes, is amended to read
as
follows:
"'328-6 Prohibited acts. The following acts and the causing thereof
within
the State by any person are prohibited:
(1) The manufacture, sale, delivery, holding, or offering for sale of
any
food, drug, device, or cosmetic that is adulterated or misbranded;
(2) The adulteration or misbranding of any food, drug, device, or
cosmetic;
(3) The receipt in commerce of any food, drug, device, or cosmetic
that is
adulterated or misbranded, and the delivery or proffered delivery
thereof
for pay or otherwise;
(4) The sale, delivery for sale, holding for sale, or offering for
sale of
any article in violation of section 328-11, 328-12, or 328-17;
(5) The dissemination of any false advertisement;
(6) The refusal to permit entry or inspection, or to permit the taking
of a
sample, as authorized by sections 328-22 and 328-23 to 328-27, or to
permit
access to or copying of any record as authorized by section 328-23;
(7) The giving of a guaranty or undertaking which guaranty or
undertaking is
false, except by a person who relied on a guaranty or undertaking to
the
same effect signed by, and containing the name and address of the
person
residing in the State from whom the person received in good faith the
food,
drug, device, or cosmetic;
(8) The removal or disposal of a detained or embargoed article in
violation
of sections 328-25 to 328-27;
(9) The alteration, mutilation, destruction, obliteration, or removal
of the
whole or any part of the labeling of, or the doing of any other act
with
respect to a food, drug, device, or cosmetic, if the act is done while
the
article is held for sale and results in the article being adulterated
or
misbranded;
(10) Forging, counterfeiting, simulating, or falsely representing, or
without proper authority using any mark, stamp, tag, label, or other
identification device authorized or required by rules adopted under
this
part or regulations adopted under the Federal Act;
(11) The use, on the labeling of any drug or in any advertisement
relating
to the drug, of any representation or suggestion that an application
with
respect to the drug is effective under section 328-17, or that the
drug
complies with that section;
(12) The use by any person to the person's own advantage, or revealing
other
than to the department of health or to the courts when relevant in
any
judicial proceeding under this part, any information acquired under
authority of section 328-11, 328-12, 328-17, or 328-23, concerning
any
method or process which as a trade secret is entitled to protection;
(13) In the case of a prescription drug distributed or offered for
sale in
this State, the failure of the manufacturer, packer, or distributor
thereof
to maintain for transmittal, or to transmit, to any practitioner who
makes
written request for information as to the drug, true and correct
copies of
all printed matter which is required to be included in any package in
which
that drug is distributed or sold, or such other printed matter as is
approved under the Federal Act. Nothing in this paragraph shall be
construed
to exempt any person from any labeling requirement imposed by or under
other
provisions of this part;
(14) (A) Placing or causing to be placed upon any drug or device or
container thereof, with intent to defraud, the trade name or other
identifying mark, or imprint of another or any likeness of any of the
foregoing; or
(B) Selling, dispensing, disposing of, or causing to be sold,
dispensed, or
disposed of, or concealing or keeping in possession, control, or
custody,
with intent to sell, dispense, or dispose of, any drug, device, or
any
container thereof, with knowledge that the trade name or other
identifying
mark or imprint of another or any likeness of any of the foregoing has
been
placed thereon in a manner prohibited by subparagraph (A); or
(C) Making, selling, disposing of, or causing to be made, sold, or
disposed
of, or keeping in possession, control, or custody, or concealing,
with
intent to defraud, any punch, die, plate, or other thing designed to
print,
imprint, or reproduce that trade name or other identifying mark or
imprint
of another or any likeness of any of the foregoing upon any drug,
device, or
container thereof;
(15) Except as provided in part VI and section 461-1, dispensing or
causing
to be dispensed a different drug or brand of drug in place of the drug
or
brand of drug ordered or prescribed without express permission in each
case
of the person ordering or prescribing;
(16) The distribution in commerce of a consumer commodity as defined
in this
part, if such commodity is contained in a package, or if there is
affixed to
that commodity a label, which does not conform to this part and of
rules
adopted under authority of this part; provided that this prohibition
shall
not apply to persons engaged in business as wholesale or retail
distributors
of consumer commodities except to the extent that such persons:
(A) Are engaged in the packaging or labeling of such commodities; or
(B) Prescribe or specify by any means the manner in which such
commodities
are packaged or labeled;
(17) The selling or dispensing in restaurants, soda fountains, drive-
ins,
lunch wagons, or similar public eating establishments of imitation
milk and
imitation milk products in place of fresh milk and fresh milk
products
respectively; of liquid or dry products which simulate cream but do
not
comply with content requirements for cream in place of cream; of non-
dairy
frozen desserts which do not comply with content requirements for
dairy
frozen desserts in place of dairy frozen desserts; and of any other
imitation food or one made in semblance of a genuine food in place of
such
genuine food, unless the consumer is notified by either proper
labeling or
conspicuous posted signs or conspicuous notices on menu cards and
advertisements informing of such substitution, to include but not
limited to
the substitution of imitation milk in milk shake and malted milk
drinks;
(18) Wilfully and falsely representing or using any devices,
substances,
methods, or treatment as effective in the diagnosis, cure,
mitigation,
treatment, or alleviation of cancer. This paragraph shall not apply to
any
person who depends exclusively upon prayer for healing in accordance
with
teachings of a bona fide religious sect, denomination, or
organization, nor
to a person who practices such teachings;
(19) The selling or offering for sale at any food facility which
serves or
sells over the counter directly to the consumer an unlabeled or
unpackaged
food that is a confectionery which contains alcohol in excess of one-
half of
one per cent by weight unless the consumer is notified of that fact
by
either proper labeling or conspicuous posted signs or conspicuous
notices on
menu cards and advertisements;
(20) The sale to a person below the age of twenty-one years of any
food
which is a confectionery which contains alcohol in excess of one-half
of one
per cent by weight[.];
(21) After December 31, 2008, the manufacture, sale or delivery or
holding
or offering for sale of any food containing any amount of aspartame
and its
derivative compounds in any of their trade names."
SECTION 4. This section shall not apply to the sale, delivery,
holding, or
offering for sale of any food product containing aspartame prior to
January
1, 2009.
SECTION 5. Statutory material to be repealed is bracketed and
stricken. New
statutory material is underscored.
SECTION 6. This Act shall take effect upon its approval.

The 2008 Legislative session opened on 16 January and will adjourn on
1 May
2008. During this time, we will take up the carryover bills from the
2007
session, the supplemental state budget, various resolutions as well as
new
bills introduced this year. I am in the process of filing bills and
resolutions on behalf of Maui, Moloka'i, Lana'i and Kaho'olawe to make
our
home even better.

2003: John F. Kennedy School of Government, Harvard University
* Program for Senior Executives in State and Local Government.
As
the devolution of the Federal Government continues, senior officials
at the
state and local levels are under more pressure than ever. They are
taking on
increasingly complex challenges with fewer resources, under a greater
degree
of scrutiny.
* The Senior Executives in State and Local Government program
provides training that helps officials assess the tasks they face in
managing today's results-driven government agencies. In particular,
the
program provides an opportunity for them to:
o Develop new conceptual frameworks for addressing
policy
issues
o Explore the relationship between citizens and
government
o Examine the ethical and professional responsibilities
of
leadership
o Exchange ideas with experienced faculty and
participants
from diverse backgrounds
The program has been designed to challenge assumptions and

2003: Flemming Leadership Retreat I and II, Washington, DC
The Flemming Fellows Institute represents the cornerstone of
the
CPA's efforts to identify and nurture leaders who can move ideas to
action.
It is founded on CPA's belief that government must be a dynamic,
active
partner with the private and nonprofit sectors to achieve real
progress. The
program focuses on three core areas: moving ideas to action, a focus
on
values and promoting teambuilding and consensus.
2003: Council of State Governments Henry Toll Fellowship Program
The Henry Toll Fellowship holds the national reputation of
being the
most prestigious leadership development program for state government
officials. CSG's mission for the Toll Fellows Program is to equip
talented
state policymakers with the skills and strategies to meet the
leadership
challenges these turbulent, dynamic times demand. Participants have
two
things in common; an intense desire to improve state government and
their
effectiveness as public servants. The Toll program brings the states'
best
and brightest emerging leaders to Kentucky for an intensive five-day
"intellectual boot camp" to develop the next generation of leaders
from the
three branches of state government.
2000: Leadership Academy for Asian Pacific American Elected
Officials
Program
This non-partisan program, co-sponsored by the Asian Pacific
American Institute for Congressional Studies (APAICS) and the UCLS
Asian
American Studies Center is open to officials of all political views,
and is
designed to develop the skills Asian Pacific American elected
officials need
to advance in their careers.
1999 - 2000: Pacific Century Fellows Program
Class of 2000 -- Intensive training program to develop leaders
with
a greater awareness and sensitivity of the people and institutions of
Hawaii, and is based on the White House Fellows Program. The program
encourages the development of long term relationships between leaders
young
and old. The program is a nine-month program beginning in September.

Mele Carroll was appointed by Governor Linda Lingle to represent
District 13
in the Hawaii State House of Representatives as the successor to Sol
Kaho'ohalahala. District 13 includes (East) Maui (from Paia and Haiku
to
Hana and Kaupo), Lana'i, Moloka'i, Kalaupapa, and Kaho'olawe.
Mele was raised on the island of Oahu and studied business at Hawaii
Community College and the University of Hawaii - Hilo. She moved to
Maui in
1987 where she met her husband and has been married for sixteen years.
Prior to her appointment to the state legislature, Mele served as
Executive
Assistant to Maui County Mayor Alan Arakawa and as his Chief
Legislative
liason to the Hawaii State Legislature with direct responsibility
regarding
District 13.
Mele worked with the Lt. Governor's Office as the Substance & Drug
Abuse
Liason for Maui County. She also worked with the State Department of
Health
(DOH), State Health Planning Department (SHPDA), health providers,
Maui
Memorial Medical Center, Kaiser Permanente, Hawaii Systems
Corporation, West
Maui Primary Urgent Care group, and others on behalf of the mayor.
Mele wrote a federal grant proposal to the United States Department
of
Commerce, National Oceanic and Atmospheric Administration for $2
million
that contributed to the purchase of Mu'olea Point in Hana and worked
with
the Hana community to develop a management plan to preserve Mu'olea
Point.
Mele was also instrumental in helping to secure funding for the new
emergency medical helicopter service for Maui County through her work
with a
bi-partisan coalition of community leaders.
Mele previously served as Chief of Staff to State Senator J. Kalani
English
at the Hawaii State Senate for two years, in addition to serving two
terms
as his Chief of Staff at the Maui County Council for four years.
In the General Election of 2004, Mele received more than 19,000
votes,
including more votes in District 13 than her opponent and more votes
than
any other candidate running against an incumbent for any office in
Maui
County. Her endorsements included the ILWU Local 142, 'Ohana
Coalition, the
Sierra Club, and the Conservative Voters of Hawaii.
