Dear Mr. Feurstein:

Thank you for speaking to me on the telephone yesterday, regarding my
complaints filed with New York University Medical Center in July 2005,
which are a following and amendment of my original complaint filed in
July 2004.

On the phone, you said to me yesterday ~

"I don't know anything about any NYU Ethics Meeting.
This is not an NYU Medical Center Issue.

Take your concerns elsewhere. I'll write you a letter.
Good Bye."

If I misunderstood, please correct and clarify for me. This IS a New
York University Medical Center Issue, Mr. Feurstein.

In my Official Medical records requested from Matthew B. Smith, MD, he
states that my case was presented before the NYU Medical Center Ethics
Committee on October 3, 2004.

Smith's entry in my official medical records for October 3, 2004,
states the following:

"I spoke to Dr. Henry Weinstein, chairman of the ethics committee. I
presented case and the ethical issue to him.

He advised that I have no ethical obligation to report pt's previous
therapist.

He advised continued attention to the pt's psychological difficulties,
can concurred with my general treatment approach. He offered the
possibility of speaking to patient; however, we decided that this might
be seen as inflammatory by patient.

He offered to be available for further consultation by me."

Mr. Feurstein, I have requested this information directly from Matthew
B. Smith, MD, and he sent me a letter [August 2005] stating he will not
communicate with me.

As you know, I have a disability: I have ADHD. I do not understand what
this reference to my medical case means.

I believe Smith's refusal to provide and clarify medical information in
my medical records is illegal, as in NY State, I have the right to
access [and understand] material in my medical records.

Please note that my complaint is a follow-up of an original HIPAA
privacy complaint I filed with NYU Medical Center in July 2004,
regarding my treatment with Victoria Rivamonte, PsyD, Matthew B. Smith,
MD, and my activity an NYU Medical Center volunteer with the Child
Study Center.

Mr. Feurstein, I request clarification from you. This is clearly an NYU
Medical Center issue, if my medical case was presented before the NYU
Medical Center Ethics Committee.

As I told you yesterday on the telephone, there are very serious issues
that adversely impacted my health and my life this past year,
specifically a life-threatening suicide crisis in May 2004, during
which time I was in treatment with both Victoria C. Rivamonte, PsyD,
and Matthew B. Smith, MD.

I remind you of the following:

1. I first saw Matthew B. Smith, MD, at the NYU Adult ADHD Clinic  on
27 September 1999. His medical records indicate he told NYU he never
treated me on NYU premises; his records are incorrect, and I clarified
this to him in July 2004.

2. I served as an official volunteer for the NYU Child Center from
Spring 2003 until the end of 2004.

3. In summer 2004, I filed a HIPAA privacy complaint with NYU Medical
Center, regarding my treatment for ADHD and my volunteer work at the
NYU Child Study Center. As you know, at the time, at Dr. Smith's
request, I also provided him copies of my communication with the NYU
Compliance Office.

4. My medical case was presented before an NYU Medical Center Ethics
Committee, chaired by Dr. Henry Weinstein, who advised Smith he had no
obligation to report my "previous therapist," as quoted in my
Official Medical records requested from Matthew B. Smith, MD, regarding
my case presented before the NYU Medical Center Ethics Committee on
October 3, 2004.

5. Victoria Rivamonte provided me with an official NYU Medical Center
ADHD Adult Clinic HIPAA Notice of Privacy Practice form, in spring
2003. In July 2003, with my first privacy complaint filed with NYU
Medical Center, I provided Mark Brody, then Office of Compliance, a
copy. If you do not have this copy in your files, please let me know,
and I will provide you another copy.

6. I have filed with your office additional complaints, as clearly
stated in my previous correspondence to you, which you have not
addressed or answered.

But this IS a New York University Medical Center Issue, Mr. Feurstein.
If you are unaware of the October 3, 2004, NYU Medical Center Ethics
Committee review of my case, I suggest you investigate and respond to
my complaint with an honest and legal answer.

What You Can Do About Fraud

   * First and foremost -- REPORT IT!
   * Any person can and should report fraudulent behavior.

~ * Physicians, hospital administrators and health maintenance
organizations, in
particular, have a legal obligation under public health law to report
fraudulent practice. ~ ! ! ! ! !

What Will Happen to Your Report

   * After you file a complaint, the Department of Health will
investigate and, if it suspects fraud, present the matter to the Board.
   * The Board will carefully review your complaint, and if it appears
to describe fraudulent practice, charges will be filed and a hearing
will be scheduled. The hearing will be conducted before a panel of two
physicians and one public member.
   * If the medical professional is found guilty of fraud, penalties
may be imposed, such as unpaid community service, fines, suspensions or
license revocations.
   * Successful prosecution of fraud will be publicized in a widely
distributed written report and on the Internet. The name of the person
filing the complaint will be held in confidence, as required under law.
Legal action cannot be upheld against a person filing a complaint in
good faith.

Examples of Medical Fraud

   * False and intentionally misleading statements to patients.
   * Submitting false bills or claims for service.
   * Falsifying medical records or reports.
   * Lying about credentials or qualifications.
   * Unnecessary medical treatment or drug prescription.

Common Misconceptions

The following are common misconceptions
About Suicide

  1. "People who talk about suicide won't really do it."

     Not True
     Almost everyone who commits or attempts suicide has given some
clue or warning. Do not ignore suicide threats. Statements like "you'll
be sorry when I'm dead," "I can't see any way out," -- no matter how
casually or jokingly said may indicate serious suicidal feelings.

  2. "Anyone who tries to kill him/herself must be crazy."

     Not True
     Most suicidal people are not psychotic or insane. They must be
upset, grief-stricken, depressed or despairing, but extreme distress
and emotional pain are not necessarily signs of mental illness.

  3. "If a person is determined to kill him/herself, nothing is going
to stop him/her."

     Not True
     Even the most severely depressed person has mixed feelings about
death, wavering until the very last moment between wanting to live and
wanting to die. Most suicidal people do not want death; they want the
pain to stop. The impulse to end it all, however overpowering, does not
last forever.

  4. "People who commit suicide are people who were unwilling to seek
help."

     Not True
     Studies of suicide victims have shown that more then half had
sought medical help within six month before their deaths.

  5. "Talking about suicide may give someone the idea."

     Not True
     You don't give a suicidal person morbid ideas by talking about
suicide. The opposite is true --bringing up the subject of suicide and
discussing it openly is one of the most helpful things you can do.
