Please indicate to me when I will receive a reply regarding both my
complaints filed with your office, as well as other medical legal
issues,
specifically, medical information in Matthew B. Smith, MD's medical
file
of my case presented at an NYU Ethics review [see below, previously
described].

I have requested this information directily from Matthew B. Smith, MD,
and he sent me a letter stating he will not communicate with me. I
believe
this is illegal, as in NY state, I have the right to access material in
my medical records.

Further, since I have not heard from you since July, for your
information I remind you of the following:

In summer 2004, after numerous correspondences directed at Mark Brady
(Canco, Adler copied), and hearing no response,I called Mr. Brady's
office
in September 2004.

At time, I was told Mr. Brady no longer worked at NYU Medical Center,
and he had taken my complaint file away with him.

I have concerns that my correspondence file and my official complaints
may been inappropriately removed from NYU Medical Center premises, in
an attempt to conceal my efforts to register my HIPAA complaints with
NYU Medical Center.

Mr. Feurstein, once again, I request notification from you when I will
hear from you, regarding my medical legal issues, previously filed with
your office.

You sexually violated me.
You endangered my life.
You ignored when i reported to you I was in serious danger,
because I was suicidal.
You abused while I was begging for help.
You shattered my mind so badly, for months,
I disassoociated so severely I believed I was dead.
You sought no emergency contacts I provided you 5 years previous,
upon my first visit to NYU Medical Center, ADHD Clinic.
You refused to see me or return my frantic calls,
when I was screaming for help.
You took advantage of me sexually, while I was severely compromised.
You did not explaint the seriousness of my condition.
You did not offer me medical treatment that may have
averted months of hell and desintigration.
You did not seek or ask of my financial needs, or explain
my need or right for disability, as I had no health insurance,
no income, no family, no emplolyment, no significant other,
or anyone in my life to ensure my safety.
You denied this ever happened in my medical records,
obstructing my ability to protect myself legally.
You lied about your colleague's abuse and neglect.
You lied about the seriousness of my condition, eg, suicidal.
You lied about my attempts to call frantically as I was
losing my mind as a traumatic reaction to your colleague's
psychological abuse on May 13.
You failed to report, or respond to, subsequent severe episodes
that continued to unravel, as I began to talk about the abuse.
You did not take steps to treat me appropriately.
You told me I did not need legal counsel.
You told me you 'taking care' of this;
You later denied ever saying that.
You watched and allowed NYU to take further advantage of me,
when you had knowledge that should have protected me.
You later abandoned me, when I began to recover
my adult faculties and questioned such issues.
Your colleague is among the irresponsible professionals
I have ever known, short of one on my mother's case
when I was 17, who sexually abused me, when my mother
was dying.

Mr. Feurstein:

I left a telephone message with your office today, and I spoke with
Ms. Diane Nord, requesting a response from you, since I have not heard
from you since July, in regard to my complaint, and my official request
for information include in my medical records, supplied by Matthew B.
Smith, MD, concerning an NYU Medical Center Ethics review of my medical
case, and my "former therapist," Victoria Rivamonte, PsyD.

You are abusing my Federal and NY State civil rights by refusing
to respond to my complaint and my request for medical information,
pertaining to my case.

Please note that my complaint is a follow-up of an original HIPAA
privacy
complaint I filed with NYU Medical Center in July 2004, regarding
my treatment with Victoria Rivamonte, PsyD, Matthew B. Smith, MD,
and my activity an NYU Medical Center volunteer with the Child Study
Center.

Please indicate to me when I will receive a reply regarding both my
complaints filed with your office, as well as other medical legal
issues,
specifically, medical information in Matthew B. Smith, MD,'s medical
file
of my case presented at an NYU Ethics review [see below, previously
described].

I have requested this information directly from Matthew B. Smith, MD,
and he sent me a letter [August 2005] stating he will not communicate
with me.

I believe Smith's refusal to provide information is illegal, as in NY
State,
I have the right to access [and understand] material in my medical
records.

As you may know, I have ADHD, a disability, and I request clarification
of information Smith refuses to provide me. The Americans With
Disabilities Act [ADA] ensures that my rights are protected, as a
person with a recognized disability.

Further, since I have not heard from you since July, for your
information I remind you of the following:
