HI everyone I know I haven't posted din a long time. I started work and was
really getting settled in and I was called to the office and was fired.
The only excuse that was given is that my skills are not what they needed to
be. Well I came to the job with high recommendations and references. She had
the guts to tell me I did not know anything about a medical office. That
floored me since I have worked in medical offices for over 4 years. Anyways
the only thing I can think of is that they found out that I have RA and
lupus. How they found this out was that I saw one of their doctors this last
Tuesday for a sinus infection and I listed my meds and I listed my medical
history. The doc even asked me about it as well. I never called in and I was
never late not even once. The only thing I can think of is that she and the
doctors had a meeting yesterday and I could over hear some of the things
that were said and I first thought they were talking about someone else but
now I realize it was about me. I am very very upset about this and I am
wondering if anyone else out there has had to file a discrimination suit?

You can only file discrimination if they told you that you were being
fired because of your illness. Since they said it was your skills, they
have basically covered their a.ses.

That depends. I'd consult an attourney or two about this. Noone here is
really qualified to answer this question definitively.

Not necessarily true. Firstly, if you have enough exemplary reviews from
previous job, combined with statements of satisfaction at this job (like
continued employment after a trial period), you can build a case under the
ADA. Even the contradictory statement of not knowing anything about a
medical office can be used as evidence. You need a lawyer who really
specializes in this; not just any Personal Injury atty. And it never is an
easy fight. It will take some perseverance.
Furthermore, IIRC, a few state's have their own version of the ADA which are
even stricter and give the disabled more rights to sue (or at least allow
more evidence or shift the burden of proof to the employer to show the
firing was *not* because of the disability). Only a local atty can tell you
that.
Call local/regional offices for disability rights for referral to atty.

Thank you. Good advice. I have contacted a attorney and he is doing research
on this . I do not really want to make money off of this. I want to make a
point. The only monitory amount I want is lost pay between jobs.

And paid COBRA!!!!!!!
<evil grin> And outplacement costs, like printing resumes, travel expenses
to job fairs and interviews, relocation costs if a new job means moving....
(well maybe not relocation expenses) ;-)

aha... the attorney said I really haven't seen all my damages yet. I guess
gas expense to drive to interviews would be acceptable too.
