New Rule Aims to Help Workers Changing or
Losing Jobs Get Access to Health Insurance

WASHINGTON --  For U.S. workers who change or lose their
jobs, a new rule issued by the Bush administration just
before the end of 2004 could provide better access to group
health plan coverage _ in keeping with changes Congress
agreed to eight years ago.

The new rule, which becomes effective for health care
plans starting July 1, is meant to implement more of the
1996 Health Insurance Portability and Accountability Act by
making it easier to obtain group health coverage.

It limits when pre-existing medical conditions can be
excluded from coverage and requires group health plans and
group health insurance issuers to offer "special
enrollment" in certain cases.

The law, pushed through Congress by President Clinton, was
intended to guarantee access to health insurance for small
businesses with 50 or fewer employees, and to require that
insurers renew coverage for a person or group regardless of
the health status of any member of the group.

"In an era when American workers often change jobs, and
even careers, several times in the course of their lives,
it is important that they are able to respond to the modern
workplace without having to fear for their health
insurance," Health and Human Services Secretary Tommy
Thompson said this week.

Three federal agencies jointly issued the new rule based
on the 1996 law. Bush administration officials said their
rule "does not significantly modify the framework" the
Clinton administration issued in April 1997 for
implementing this part of the law.

Yet it took another 7-1/2 years for the rule to be made
final.

"We have listened to public comment and worked to craft a
rule that will provide maximum protection for consumers,
while minimizing the burden on health plans," said Medicare
chief Mark McClellan.

When Clinton signed the law, his administration said it
would affect about one in 10 U.S. workers _ then an
estimated 25 million Americans _ and their families. Those
were workers switching jobs, self-employed or with pre-
existing medical conditions. The law was sponsored by Sen.
Edward Kennedy, D-Mass., and former Kansas Republican Sen.
Nancy Kassebaum Baker.

The Bush administration changed the health insurance rule
"to bolster ... consumer protections while minimizing the
burdens imposed on group health plans and group health
insurance issuers," Thompson's agency said in a statement.

Among other things, those changes would require group
health plans and group health insurance issuers to give
workers a statement about their rights under the law.

still needs to go much further and do a lot more.  My brother spent months
looking for insurance to replace his COBRA that was running out.  My
sister-in-law has some mental illness issues and he is diabetic so they
needed a decent plan.  Despite his scrambling, nothing worked out during the
time that companies are required by law to cover pre-existing conditions.  
Now they'll be shelling out $1000/month for a policy that won't cover their
needs for several months.

In a society that actually encourages self-employment, there needs to be some
real insurance options for those who follow that path.  It sucks when someone
as intelligent and self-motivated as my brother searches for months to get
insurance on time in accordance witht he current rules and still can't do it.
Most of us don't stand a chance if he couldn't pull it off.   He makes
really good money when he works, but their medical expenses are eating it up
in no time.

And getting a statement about your rights under the law is small consolation
for not being able to buy health insurance.

I have the same problem.  my cobra ran out in oct and I cant find anyone
except blue cross that will even insure me because of pre exsist cond .and
they quoted me $2100.00 PER MONTH    . CAN YOU BELIEVE THIS. I cant afford
it so i have no insurance at all and cant get medicare  until sept of 2005.
I do a lot of praying that I stay well enough to not have to be
hospitalized, If anyone knows of a plan that might help please
let me know

Jb,

check to see if your state has a pool for people comming off of Cobra.
Almost all the states have it.

My cobra has just ran out and I am getting onto the high risk pool in
AL.

Unfort. very few people know about these pools and you may already be
past the enrollment deadline. You have to apply normally within 60 days
of your Cobra ending.

If you are unable to get on an insurance plan, but need medication, you
can usually get the meds straight from the pharmacutical company either
at a discount or free.  Almost all have a program of some type.

Janice, did you know that Cobra is extended from 18 months to 29 months
if you go on Social Security Disability while on Cobra?  I didn't know
this and had to fight to get the extra 11 months coverage which luckily
took me up to the month that Medicare kicked in.

Medicade (MediCal in California) is an income/asset dependent
Federal insurance program.  Usually (but not always) goes hand-
in-hand with food stamps and welfare (AFDC) for families with
children.  A home, a not-too-new auto, tools of the trade, TV,
wedding rings, clothing, and a few other things are not included
in the term "assets".   Transportation to doctors' appointments,
utilities (gas-electric), medical bills and medicines, and some
other items are subtracted from income.

I strongly urge you and others in your situation to check it out.

Unfortuantely, I can believe it all too well.  This is a part of our health
care system that really needs to be addressed more adequately.

Come to think of it, have you written to your folks in Congress about your
situation?  I don't think they'll be able to help immediately, but the more
they hear about this from their constituents (sp?), the better chance there
is that something will improve one day.  I think it's time for me to start
bothering my Michigan Congressfolks about this, now that I'm voting up here.

Oh Man Janice, I feel for you. I am kind of scared that is going to happen
to us in June also. I am cobra right now and our `8 months run out in June.

If you need to vent about it sometimes my email is always open.
