Genghis Khan's Wife - 13 Nov 2005 20:34 GMT
I posted my dad's will into probate for him.  Now I live in another state
and I did in District Court. It is a military will good in all state but LA.
I have power or attorney and guardianship, and all the legal things saying I
the ONE. My sister, miss not do anything but take the glory, is yelling I
stepping out of bounds.  The family fight is starting.  My sister has filed
and sued me on the grounds I crazy and not able to do it.  I not sure want
she is up too My lawyers one in each state says not to worry.  Thank god,
Dad here now.  .  I know I am not sane often but want can I do?  I know am
looking for a lawyer for this.  Gary my lawyer here: says not to worry and
that dad is here.  I not wanting to loose more of my family but I so tried.
If I was sane before all this and I afraid I will loose it and loose my
sister.  I just sooo tried and I going to been the bigest , meanest ,
evilest thing she has seen.

I hope your Dad's will is more lucid than that.

Why not let your sister take the burden if she is so keen, usually its the
other way round , no one wants it :-)

MY sister was not made the caregiver or has power of attorney.   She wants
to put Dad away and spend his money.  She has done it before.  All I want is
to make his last years as happy as possible.  But according to the family I
am the B___ch because of that view.  I just tried of the fight. Dad happy on
the ranch, he has is fishing spot and a nurse.  Yes, I got a nurse to stay
with him day and night.  We all happy on the ranch.  He even went fishing
without anyone.   The ranch is big and all my neighbors know about Dad.
They even help me move Dad and Dad is making new friends.  He smiling and
playing with my kids. I believe this type of home setup is better for him.
I had seen my sisters do things before.  And the paper for the suit came
today. Nice.  I just freaked

'the family' or your sister?

anyway, IANAL but seems to me that with the set up as described by you, on
what basis would a suit be brought/succeed? I think it might be a good idea
to video the sort of stuff you menioned so no one can claim he is unhappy.
careful with the fishing stuff if he could fall in, is there someone to keep
an eye on him (the nurse?), otherwise maybe they could claim he is in
danger?

are they complaining because you are spending his money on a nurse? Your
sister needs to be careful she doesnt end up diverting the money to lawyers,
it has happened before.

that's what lawyers are for.  if he gave you the POAs then you
should have nothing to worry about, especially if they're in
another state.

sounds like they think that they can get at his money by putting
him in a home, but they obviously don't know what kind of trouble
that could get them into, including criminal charges.

sounds like you're doing the right thing.

I'm a little lost here.  How can you post your dad's will for probate if
he
is still living?
