* Is it fraud to head up an Internet Newsgroup for the purpose of
learning the identities, and personal information of litigants to a
tragedy? Especially, if you are representing you are on the same side
of the issue that they are, but evidence shows otherwise?
* If your purpose for setting up a Newsgroup, or Newslist, is to
collect up/archive identities, and personal information, and dialogue,
for the purpose of attorneys and other parties adversarial to those
harmed, shouldn't you have an obligation and responsibility to fully
disclose whom it is you are working for?
* If you are moderating an open internet forum for breast implant
survivors, shouldn't you have a responsibility to disclose the perils
of giving out personal information and identification on the internet,
when it is open for the public to see, and being archived for easy
retrieval?
* If you are an employee of a corporation, insurance company or any
other party that is adverse to litigants or those harmed, shouldn't
you have the legal and moral responsibility to disclose who it is you
are working for, while you are amongst those who you could and will
likely harm?
* If you have as a self-appointed advocate of women harmed by breast
implants, you decide to socially meet an attorney of an breast implant
manufacturer, for idle chit-chat, and you discuss the private affairs
of one of the victims, wouldn't it be morally reprehensible, and a
breach of your fiduciary responsibility as an advocate, to publically
post that information all over the internet and newsgroups?
* If you have set yourself up as a non-profit for the purpose of
gaining contributions from those that are parties to the tragedy,
shouldn't you be expected to fully disclose the receipt of those
funds, and especially whom they are coming from? Wouldn't this
disclosure be necessary to determine whether or not the funds are
being contributed by those beneficial to your stance, rather than
against them, or at cross-purposes?
* If you set up an "open" Newslist of those harmed, and you represent
that one of it's members is absolutely not a party from the adverse
side of the position, and is actually against them, collecting
personal information for use in litigation matters, couldn't, and
shouldn't you be expected to be held accountable legally? Especially,
in light of the fact that you are encouraging open conversations, and
even suggesting that you ought to trust each other enough to share
private addresses and phone numbers.
* If your position is actually in alignment with those harmed by a
tragedy, but your purpose is to gather information for the purpose of
selling information to interested parties, or steering individuals to
certain professionals for referral fee purposes, shouldn't you
disclose that? Banks, lending institutions, insurance companies, and
others, we come into contact with are required to have signed
affidavits from us in order to sell our private information for
profit, or gain from that information in anyway.
* Wouldn't setting up an "open" Newslist or Newsgroup, where those
harmed and in litigation, are co-mingling with those that are
adversarial to their position, possibly be in violation of Judge
Pointer's Article 8? Especially, if you know the true identity of at
least one of the individuals is adversarial to the harmed individuals'
position, and you have hidden and lied about it?
* If you "self-appoint" yourself as a leader and representative of
those harmed by a tragedy or faulty product which places them in
litigation against those responsible, shouldn't you have a paramount
responsibility morally, to represent them with the best demeanor,
image and highest integrity possible for the media, public, and those
that will be in audience to hear the concerns, and issues of those
harmed?
