TAMPA -- A misdemeanor prostitution arrest at Fletcher Avenue near
Interstate 75 turned into a felony Tuesday morning after the defendant
told authorities he was HIV positive, Hillsborough deputies said.

Patrick Lynn Whaley, 39, of 10019 Courtney Palms Blvd. in Brandon, was
charged with misdemeanor prostitution and criminal transmission of
HIV, a felony.

Deputies say he agreed to perform a sex act in exchange for $200. He
also offered to give a professional massage despite not being a
licensed massage therapist, which added another misdemeanor charge of
the unlicensed practice of a health care profession.

Whaley was being held in the Orient Road jail with bail set at $1,500.

What do you wanna bet he won't spend a day in prison?  I'm surprised he
is even in the county jail or that they set the bail so high (almost
an entire week's worth of crack).  He will be offered a plea bargain
and convicted of aggravated loitering or something that doesn't require
locking him in a giant cage with ten thousand horny men whose medical
care is paid for by the state.

The part about the massage is hilarious, because everyone knows that
"massage" is code for sex (you're getting one part of your body massaged,
at least).  I've heard of massage parlors getting busted for engaging in
prostitution, but I've never heard of a prostitute getting busted for
offering a real massage.  This would normally make for a good episode of
Jerry Springer, except he avoids HIV/AIDS as a topic because that isn't
very entertaining.
