Site not found, which means that it was removed for illegal content because
complaining about catching HIV is construed as inciting hate towards an
identifiable group (gay men and/or AIDS patients of any type).  The man can
still sue under Australian law, but the media may not report any details
because they might create a negative impression of minority groups that
spread HIV.

HIV victim to sue 'negligent' government Font Size: Decrease Increase
Print Page: Print October 11, 2007
A MAN who was infected deliberately with HIV by another man is suing the
South Australian Government for negligence.

The man has accused Stuart James McDonald, who is awaiting trial on seven
charges of endangering life, of deliberately infecting him with the virus.

McDonald, who was arrested in April this year, allegedly had unprotected
sex with men after placing an internet advertisement.

It has been alleged McDonald failed to tell the men he had the virus or
lied about his status.

Lawyers for one of the alleged victims, who cannot be named, said the law
suit against the SA Government would be based on claims of negligence.

The man's lawyer, Peter Humphries, said his client had unprotected sex with
McDonald in October 2005.

The man believed SA's Health Department was negligent because they had
received reports about McDonald's activities but failed to act.

"That was at a time, as far as we understand it, at least two reports had
been made to the Health Department of McDonald's practice of engaging in
sexual activity without protection, knowing full well he was carrying the
HIV virus," Mr Humphries told ABC radio.

"He (the alleged victim) has been put in this position needlessly.

"Had McDonald been put under some sort of control orders, given his
complete lack of interest in exercising self-control, then this whole thing
would have been avoided."

A State Government spokesman today declined to comment.
