Unfortunately this news article is a bit thin on facts and details,
however it suggests that HIV has progressed from being an invisible
virus to a "deadly weapon."

<http://abclocal.go.com/wtvd/story?section=local&id=5479079>:

"According to published reports, investigators charged 25-year-old
Private First Class Johnny Dalton with assault with a deadly weapon,
among other charges.

The HIV positive Dalton is accused of having unprotected sex with a
man and failing to him about the virus.

The soldier is with the 22nd Aviation Support Battalion, and the other
man is not a soldier."

Cases like this are nonsense. Everyone is aware of how HIV is supposed to be
spread, and if people don't take precautions that's their problem.

That sounds reasonable to me.

Anyone asking me "Do you have HIV" or "Are you HIV positive" would
receive the answer "No."

And, as I have never been tested for HIV, my answer would be honest
and correct.

I feel like I've just gazed into an abyss.

Be careful, you know what that quaint Mr. Friedrich Nietzsche said about
that.

We must look into abysses, in spite of the danger, to understand
what motivates monsters.

One figures that a person who knows he has HIV should not be
punished for exposing his uninformed sexual partners because
his partners should have taken precautions.  (And burglars don't
deserve to be in prison because their victims should have used
better locks.)

The other figures that if knowingly exposing others to HIV is a
crime, then he can avoid the risk of punishment by taking care
not to know.

No, it would be a lie because you DON'T KNOW your infection status.
If you told them you didn't know they probably wouldn't f.ck you.

Is it still a lie if I believe what I am saying is true, and no one
can prove me wrong?

Not a great loss.  The ones who say no are probably like you, anyway.

Sounds like religion to me.

There is a medical physicist in Perth who is your perfect match.

I hope everything goes well.

Very strange, as both attacker and victim are male.  But since the
attacker is in the army and HIV enjoys no privileged status in
the military, the case will be prosecuted even though the victim
isn't female like in most other cases.

Some more details about this case have been reported.

Presumably the soldier has been charged with "assault with a deadly
weapon" because there is no specific state law concerning the
transmission of HIV.

As I've mentioned before, here in the UK the "grievous bodily harm"
law is usually used in such cases.  I'm not sure if there's an age of
consent problem in this case.  Again, here in the UK, the age of
consent is 16.

"Crimes against nature" is a new one for me.  What's that all about?
Does nature get called as a witness in court?

Full story at <http://www.wral.com/news/local/story/1599161/>:

"A Fort Bragg soldier is charged with knowingly infecting a teenage
boy with human immunodeficiency virus, or HIV.

Officers arrested Pfc. Johnny Lamar Dalton, 25, after a
five-month-long investigation by Fort Bragg military police and the
Cumberland County Sheriff's Office. Dalton is attached to the 82nd
Airborne.

Dalton first met the unidentified boy, 17, in a gay online chatroom
and then in person, said the boy's mother.

In November, Dalton's commander ordered him not to have sex without
first telling partners of his illness, said a spokesperson for the
82nd Airborne. Dalton also signed a written order to that effect.

[...]

'My son received it (HIV) unwillingly,' said the teen's mother. "If
you willingly and knowingly ... and you purposefully do something, you
should suffer the consequences."

After five months of investigation, officers arrested Dalton, who is
married and has children, and charged him with crimes against nature,
assault and assault with a deadly weapon."

<http://www.cbsnews.com/stories/2007/07/18/national/main3070320.shtml>:
"Military and civilian authorities have charged an HIV-positive
soldier with assault with a deadly weapon, accusing him of having
unprotected sex with a partner he did not tell about the infection.

[...]

Dalton, 25, was arrested last week and was being held Tuesday in
county jail on a $50,000 bond, said sheriff's department spokeswoman
Debbie Tanna.

[...]

An arrest warrant filed by county officials accuses Dalton of not
telling his male partner, an 18-year-old civilian, that he has HIV,
the virus that causes AIDS. The teen's mother alerted authorities to
the relationship after her son fell ill and told her about it; he has
tested positive for HIV. Tanna said she did not know whether Dalton
was the source of the teen's infection."
